Question:
If two employees work in the enterprise and they are “unlimited” invalids of 1 and 2 groups, shall the enterprise transfer social assignments for them because they receive disability pension?

Answer:
Subject to article 8 of the Law of the Republic of Kazakhstan “On Obligatory Social Insurance” of 25 April 2003 (with changes and additions made by Laws of the Republic of Kazakhstan of 13.12.2004 and 20.12.2004), employees, private individuals including foreigners and persons without citizenship permanently residing on the territory of the Republic of Kazakhstan and fulfilling profitable activity on the territory of the Republic of Kazakhstan are subject to obligatory social insurance with the exception of working pensioners. Pensioners are persons achieved the pension age or having long military service indicated in articles 9 and 60 of the Law of the Republic of Kazakhstan “On Pension Provision in the Republic of Kazakhstan”, receiving pension payments from the State Center for pension Payments, accumulation pension funds. The abovementioned means that it is necessary to calculate and carry out payment of social assignments to the Fund monthly for working invalids, not achieved the pension age determined by the legislation or having no long military service.

Answer:
Payment of social assignments is fulfilled by employer or private individual fulfilling calculation and payment of social assignments to the Fund in the order determined by the present Law;

1. Social assignments to the Fund are paid by the payer with the exception of payer applied special tax treatments by the fulfillment of payments through bank account of the Center not later than the 15th day of the month following the financial month.

2. Payment of social assignments by the payer applied special tax treatments is fulfilled in time determined by the Tax code of the Republic of Kazakhstan.

Payment of social assignments is fulfilled by employer or private individual fulfilling calculation and payment of social assignments to the Fund in the order determined by the present Law;

Such social assignments provide the participant of obligatory social insurance system for whom social assignments have been fulfilled, and in case of loss of the supporter of the family, provide members of his family with the right to receive social payments in accordance with the present Law.

Answer:
Obligatory social insurance is set of measures organized, controlled and guaranteed by the state for compensation of part of income in connection with:
- disablement
- and (or) loss of job
- as well as loss of supporter of the family

What place takes the obligatory social insurance in the system of social protection of people of the Republic of Kazakhstan?
Obligatory social insurance is the second level (obligatory) of social protection of people representing social payments fulfilled at the expense of obligatory social insurance of working (worked) people.
Obligatory social assignments of employers are the source of social insurance payments. Level of social provision in this case depends on the duration and rate of participation of each person in the insurance system.
